The only warranties applicable to any roofing system are those expressly made in writing by Koppers in connection with and pursuant to the Koppers Built-Up Roofing Warranty Program. Any such warranties are expressly in lieu of all other warranties of any kind, type or nature, and are the exclusive warranties of Koppers with respect to (A) any roofing products or components manufactured or supplied by Koppers or, as appropriate, (B) any roofing system. Koppers hereby disclaims all other warranties, including, but not limited to, all warranties of merchantability and fitness for a particular purpose.
